By completing the Like A Record 360 enquiry form and paying the holding deposit, the hirer or their agent is agreeing to the following terms & conditions.
Hiring, Delivery and Service
Delivery, set up and removal of the videobooth occurs inside of the booked rental period.
One or two videobooth attendants will remain with the videobooth for the duration of the booking time.
The complete details and inclusions of your package will be disclosed to you in writing by Like A Record 360 at the time of your booking.
Our Requirements / Workplace Health & Safety requirements
We require two chairs, a table, and a clean, flat, dry, smoke free area of approximately 3m x 3m x 2m (which includes space for our attendant tables) and one normal power outlet within 10 metres. If the videobooth is to be set up outdoors, the booth and attendant will require sufficient protection from the elements, in the form of sufficient overhead and side cover on at least two sides, to afford protection from rain, humidity, wind and/or sunlight. It will be the hirer’s responsibility to ensure their venue function coordinator or private function coordinator is made aware of these requirements and can accommodate them.
For safety reasons and to avoid damage to the videobooth, drinks, glasses or bottles, food or cigarettes (including e-cigarettes) are not allowed on the videobooth.
For safety reasons and to protect the videobooth, clients and guests are not permitted to pick up other guests, when on the videobooth platform.
Safety precautions/booth rules:
* No food, drinks, cigarettes or e-cigarettes on the booth.
* No chairs or other objects to stand on to be taken onto the videobooth.
* No lifting up guests, piggy backing or hand stands, or any kind of gymnastics on the videobooth platform.
* No props to be removed from the videobooth area.
* The camera spins around the platform on which clients and guests stand. Please do not dismount the platform until the camera has come to a complete stop.
Props
We agree to supply a wide variety of props for our clients and their guests to use at their booked event. We reserve the right to withhold or remove all or certain props from use if the attendant considers they are being damaged, mistreated or continually removed from the videobooth area. Children under the age of ten must be supervised by an adult when selecting props and when operating the videobooth.
Use of Images/Privacy
When hiring from Like A Record 360, the hirer gives permission for images captured at the event to be used on the Like A Record 360 website and for advertising purposes.
Like A Record 360 will not use images which are deemed unsuitable or inappropriate on our website or for advertising and will not use any content that we consider may be personally damaging to any person(s).
Like A Record 360 will not sell your personal details to any third party and will take all reasonable measures to ensure that your personal details remain confidential.
Failure to Complete
At all times care will be taken by Like A Record 360 to ensure delivery of the booked package, however, should unforeseen equipment failure prevent this, during the normal course of events, liability will be limited to a total or partial refund of monies paid, dependent on our deliberation of the unique circumstances and/or the amount of the booking that was fulfilled successfully.
Like A Record 360 cannot be held in any way liable if equipment or accessories failure or damage (including electrical, water or other liquid damage) is due to any negligence, an act or fault on the part of any venu e or venue staff or is due to any negligence, act or fault on the part of any client or client guest or other person using a Like A Record 360 videobooth at your event/function, which negligence, act or fault, wilful or accidental in turn prevented the successful completion of the agreed to Like A Record 360 service(s).
Travel
A travel surcharge may apply to events located more than 30 minutes normal travel time from our nearest base. Any travel charges must be agreed to by both parties and shall be disclosed in writing by Like A Record 360 prior to booking.
Parking
Any parking fees assigned to the videobooth attendant’s vehicle in the course of delivering the videobooth, remaining at the venue to operate the videobooth, and removing the videobooth at the end of the booked period to are to be covered by the hirer.
Short Bookings
For any booking up to 3 hours, should the client, or their representative decide to extend the booked time during the course of the event, the extended rates will be $330 per hour, payable at the beginning of the extended time, as a cash payment.
Delays
Like A Record 360 cannot be held responsible for unforeseen delays at the venue, which are out of our control.
Force Majeure
Like A Record 360 will not be liable for failing to perform under the agreement by the occurrence of any event beyond our reasonable control, including a labour disturbance, fire, threatened or actual act of terrorism, natural disaster, extreme weather events (including but not limited to flooding, cyclones, earthquakes, which events might prevent the videobooth attendants from attending the venue or to perform his/her duties whilst at the venue), or war. Like A Record 360 will not be held liable for failure to attend a booked event or complete a booked event in the event of closure of the venue prior to or during a booked event or cancellation of a booked event by the venue or by cancellation of a booked event or closure of the venue by other parties or Government authorities, representatives or bodies.
Payments
A 30% deposit payment is required from the hirer or their agent, within 7 days of receipt of an invoice from Like A Record 360. The remaining balance will be payable by the hirer or their agent at least 14 days before the booked date, unless otherwise agreed to in writing by both parties.
Security Statement
Our banking details for direct deposit will be noted on your invoice and should not change at any time. If you receive any emails purporting to represent Like A Record 360, listing changes to our banking details, please contact Like A Record 360 by phone before making any payments. We will not be held liable for payments made to the wrong location.
Cancellation
If a cancellation is made by the hirer or their agent or Like A Record is unable to attend the booked event due to closure of the venue for any reason within 30 days of the booked date, the deposit and all monies paid to that date will be forfeited, unless Photobooths Australia can replace the hirer’s booking with a new booking for the original booked date, in which case all money paid to that date will be returned to the hirer or their agent, minus the 30% holding deposit. If Like A Record 360 has not received final payment for a booking at least 48 hours before the booked date, Like A Record 360 will deem that a cancellation on behalf of the hirer and all monies paid to date will be forfeited, unless both parties have made prior mutually agreed to arrangements in writing for a late payment.
Postponement
If a client wishes to move a booking to another date it will be at the discretion of the Like A Record 360 management staff as to whether this is a viable option. In most cases a postponement can be arranged, however if the management deems the postponement unviable, the booking will be deemed a cancellation and the above cancellation terms will apply.
Miscellaneous
The Like A Record 360 operator(s) may pause or terminate the use of the videobooth at any time during the event if they consider that the guests are behaving in a way that the operator(s) believes to be dangerous to themselves or any persons, or potentially damaging to the product.
The videobooth attendant(s) reserves the right to exclude a person or persons from the videobooth if the attendant considers that person to be grossly intoxicated or behaving in an aggressive or abusive manner towards the videobooth attendant(s) or behaving in a manner that the videobooth attendant(s) considers may damage Like A Record 360 property.
